Terms of use

Agreement

By using Apex Metric you agree to these terms and our privacy policy. If you do not agree, please do not use the app. You must be at least 13 years old, and at least 16 to use community features.

Health and safety

• Talk to a doctor before starting any exercise or nutrition program, especially if you have a health condition, injury, are pregnant or take medication.
• Stop immediately if you feel pain, dizziness or shortness of breath.
• Use proper form, a spotter and safety equipment. Choose weights you can control.
• You exercise at your own risk.

Your account

Most features work without an account. For community features you sign in with Apple, Google or an email code. Keep access to that account secure. You are responsible for activity under your account. You can delete it anytime in the app (see delete your account).

Free period, subscriptions and purchases

• Free period: new users get Premium features free for 3 months from first install. No payment information is required and nothing is charged when it ends; you move to the free plan.
• Premium: available as a monthly or yearly auto-renewing subscription, or a one-time lifetime purchase. Prices are shown in the app before purchase.
• Billing: payment is charged to your Apple ID or Google Play account at confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel in your Apple ID or Google Play subscription settings.
• Refunds are handled by Apple or Google under their policies.
• We may change prices with notice in line with store rules. Free months earned through invites are added to your access and have no cash value.

Community rules

When you post, comment or join a crew you must follow the community guidelines. We may remove content and suspend or delete accounts that break them, without notice when needed to protect others.

Your content

You own what you post. You give us a worldwide, non-exclusive, royalty-free license to store, display and transmit it only to the audience you choose, for the purpose of running the app. This license ends when you delete the content or your account, except for copies other users already saved or that we must keep by law. You confirm you have the rights to anything you post.

Our app and content

The app, its design, plans, coaching and software belong to us or our licensors. We grant you a personal, non-transferable license to use the app on devices you own or control. Exercise images and instructions come from the public-domain free-exercise-db project; food photos are from Wikimedia Commons contributors and are credited in the app. Do not copy, reverse engineer, resell or misuse the app.

Third-party services

Apex Metric works with Apple Health, Health Connect, Apple Watch, smart scales, Open Food Facts and other services we do not control. Their terms apply to your use of them.

Disclaimers and limitation of liability

The app is provided "as is" and "as available". To the fullest extent allowed by law we disclaim all warranties, including fitness for a particular purpose, and we do not guarantee results, accuracy of estimates or uninterrupted service.

To the fullest extent allowed by law, [Company legal name] is not liable for indirect, incidental, special or consequential damages, or for injuries resulting from exercise or diet, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Ending these terms

You can stop using the app at any time. We may suspend or end your access if you break these terms. Sections about content licenses you granted, disclaimers, liability and governing law survive.

Governing law

These terms are governed by the laws of [State/Province and Country], except where the law of your country of residence gives you rights that cannot be waived.

Apple and Google

If you downloaded the app from the Apple App Store: these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app (including product liability, legal compliance or intellectual property claims). If the app fails to conform to any warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not in a country subject to a US Government embargo and are not on any US Government list of prohibited parties. The same principles apply to Google if you downloaded the app from Google Play.

Changes and contact

We may update these terms and will post changes here with a new date. Continuing to use the app after changes means you accept them.
